Abstract

The objective of this article is to get a first glance at the conditions under whichforeign law is being adopted in Chilean consumer law. Under the assumption thatlegal transplants are feasible in consumer law matters, this paper looks to diagnosethe way in which legal transplants have taken place in Chilean consumer law,analyzing for such purpose two laws: Law No. 20,555 and Law No. 21,236. After adocumentary analysis of said laws, their track record and the technical reports of theLibrary of the National Congress, it is concluded that the incorporation of foreignlaw occurs blindly.
